Exhibit E: Terms and Conditions

The Outfitter and Guide Permit is subject to additional terms and conditions including, but not limited to:

A. Starting and ending dates that are negotiable, subject to the term not exceeding one year.

B. Fee for commercial use. The Forest Service has an established flat fee for institutional use which is charged for each service day of non- degree pursuit activities (one person for one day or portion of a day is one service day). The flat fee is subject to an annual adjustment. As an example, the Forest Service flat rate fee for day use institutional type activities is .74 cents and for overnight type uses it is $1.07 per service day. Fees for use must be paid in advance of use.

The fee for commercial use is subject to an annual minimum, currently $80/year, regardless of the type of use authorized. Additional fee for commercial use assessment(s) will be made for any uses in which the cumulative fee assessed is in excess of the minimum fee for the use. However, as an accredited educational institution, no additional fees will be assessed of MSU for uses associated with credited programs leading toward graduation or a degree.

C. Indemnification of the United States from liability to the public for property damage, and bodily injury or death for which MSU may be liable. Current minimum coverage includes:

Property damage - $25,000
Single injury - $300,000
Multiple injury - $300,000
