110.00 Definitions
"Academic Support Faculty" means a person appointed to a
nontenurable position who has rank and who assists with the
instructional mission of the University. It includes persons with
Visiting, Adjunct, and Affiliate titles.
"Advertisement" means the edited vacancy announcement
placed in newspapers and professional journals and posted on the
world wide web and computer bulletin boards to inform prospective
applicants a position is open. (See Section 10.)
"Affirmative Action" means the activities the University
undertakes to guarantee equal opportunity, overcome the present
effects of past discrimination, and prevent underutilization of
qualified women and minorities, persons with disabilities, Vietnam
era and disabled veterans. (See Section 2.)
"American Indian/Alaskan Native" means a person having
origins in any of the original peoples of North America who
maintains cultural identification through tribal affiliation or
community recognition.
"Asian or Pacific Islander" means a person having origins
in any of the original peoples of the Far East, Southwest Asia, the
Indian subcontinent, or the Pacific Islands, including, for example,
China, India, Japan, Korea, the Philippine Islands, Polynesia, and
Samoa.
"Black" means is a person having origins in any of the
Black racial groups of Africa.
"Board of Regents Contract" means the document which
appoints an employee on a nonclassified contract which is "regularly
budgets" and for which there is an expectation of notice of
nonrenewal. (See Sections 4-6, 18, and 19.)
"Board of Regents Contract Professional" means a
nonclassified, nonfaculty employee appointed on a Board of Regents
contract or letter of appointment, including persons appointed in
the following categories: executives/BOR administrators, contract
professionals, academic support professionals, and research
professionals.
"Career Ladder" means a plan for internal promotion
opportunities developed for a work unit or department by the hiring
authority and approved by HR/AA. Only persons who have been hired as
the result of appropriate searches are eligible for career ladder
promotions. (See Section 6-4.)
"Conditional Offer" means the verbal offer a hiring
authority extends to a candidate in order to begin hiring
negotiations. (See Sections 18 and 19.)
"Contract Professional" means a nonclassified,
nonfaculty, nonexecutive employee whose work customarily and
regularly requires the exercise of discretion and independent
judgement and whose position meets the FLSA criteria for overtime
exemption and the University criteria listed in Section 4-5.4.
"Department Head" means the person appointed to
administer the programs and supervise the faculty of an academic
department, including persons with the title of department head,
department chair, and director of the School of Art or Music.
"Discrimination" means denying a person opportunity by
treating him or her differently than other similarly situated
individuals because of stereotypes and assumptions based on race,
color, national origin, sex, sexual orientation, marital status,
age, religion, creed or political belief, mental or physical
disability, or status as a Vietnam era or disabled veteran and
without regard for individual merit and ability. (See Section
2.)
"Equal Opportunity" means non-discrimination on the basis
of race, color, national origin, sex, sexual orientation, marital
status, age, religion, creed or political belief, mental or physical
disability, or status as a Vietnam era or disabled veteran.
"Executive/BOR administrator" means a persons whose
primary responsibility is the management of the institution as a
whole or a customarily recognized department or subdivision
thereof.
"Faculty Director" means a faculty administrator
appointed to direct the activities of and faculty associated with an
academic support program such as WAMI, Mountain Research Center,
University Honors and the Undergraduate Scholars Program.
"Faculty/faculty member" means an appointee who is
engaged in the teaching, research, and/or service mission of the
University and who has academic rank appropriate to her or his
academic preparation and expertise. (See Sections 4, 5, and
6.)
"Finalist" means a candidate who remains active in a
search after the committee has completed all its preinterveiw
screening activities, usually including reference checks and
telephone interviews. The list of finalists is reported to the
hiring authority and HR/AA. (See Section 14-6 and 15.)
"Foreign National" means a person who is not a citizen of
the United States or a permanent resident alien. (See Section
15-9.)
"Hiring Authority" means the person authorized by the
President of MSU-Bozeman or designee to commit budget resources and
make hiring decisions subject to administrative and Board of Regents
approval.
"Hispanic" means a person of Mexican, Puerto Rican,
Cuban, Central or South American or other Spanish culture or origin,
regardless of race.
"Instructional Expectations" means that a tenurable
faculty member is responsible for teaching, research/creative
activity, and service as defined in his or her letter of hire and/or
faculty role statement. (See Sections 5-2 and 18 and MSU-Bozeman
Faculty Handbook Section 600.00.)
"Letter of Appointment" means the document which appoints
an employee on a nontenurable, nonclassified contract which is not a
Board of Regents contract and has no notice of nonrenewal. It should
follow the letter of appointment template in Section 19.
"Letter of Hire" means the document that appoints an
employee on an initial Board of Regents contract. It should follow
the letter of hire template in Sections 18 and 19.
"Minority" means a person who is Black (Non-Hispanic),
Hispanic, Asian or Pacific Islander, or American Indian/Alaskan
Native.
"Mixed Race" means a person identifying themselves as
having origins in more than one racial group.
"Person with a Disability" means an individual who has a
physical or mental impairment which substantially limits one or more
major life activities, has a record of such impairment, or is
regarded as having such an impairment. "Major life activities" means
functions such as caring for oneself, performing manual tasks,
walking, seeing hearing, speaking, breathing, learning, and
working.
"Position Description/Position Description Questionnaire"
means the document which describes the duties and responsibilities
of a job in detail, forms the basis for the vacancy announcement and
advertisements, and becomes a part of the employee's permanent file.

"Professional Practice Expectations" means that a
tenurable faculty member is responsible for activity in one or two
of the three areas of teaching, research/creative activity, and
service, as defined in his or her letter of hire and/or faculty role
statement. (See Sections 5-2 and 18 and MSU-Bozeman Faculty Handbook
Section 600.00.)
"Protected Class" means, as defined by federal
regulations, women, minorities, persons with disabilities, Vietnam
era veterans, and disabled veterans. (See Section 15-2.)
"Rank" means the academic title of a faculty member
including Assistant Professor, Associate Professor, and Professor
for tenurable faculty and these titles with modifiers "Research,"
"Visiting," "Adjunct," and "Affiliate" for nontenurable faculty.
(See Section 4-5 and the MSU-Faculty Handbook Section 300.00.)
"Search Committee" means the committee appointed to
recruit, evaluate, screen, interview and make recommendations
regarding applicants for a position.
"Sexual Preference/Sexual Orientation" means having a
preference for heterosexuality, homosexuality or abstinence, having
a history of such a preference, or being identified with such a
preference.
"Screening Committee" means the committee appointed to
evaluate, screen, interview and make recommendations regarding
applicants for a position.
"Special Disabled Veteran" means (1) a veteran who is
entitled to compensation (or who but for the receipt of military
retired pay would be entitled to compensation) under laws
administered by the Veteran's Administration for disability (a)
rated at 30 per centum or more, or (b) rated at 10 or 20 percent in
the case of a veteran who has been determined under section 1506 of
Title 38, U.S.C. to have a serious employment handicap, or (2) a
person who was discharged or released from active duty because of a
service-connected disability.
"Tenurable faculty/tenurable faculty member" means a
person engaged in the teaching, research, and/or service mission of
the University who has an academic rank associated with the process
of earning tenure (see MSU-Bozeman Faculty Handbook Section 320.00)
and an appointment which may lead or has lead to tenured status as
defined in MUS Policy 706.1 (cited in MSU-Bozeman Faculty Handbook
Section 500.00.
"Vacancy or Position Announcement" means the document
used to notify potential applicants that a position is open via
posting onworld wide web, bulletin boards and inclusion in mailings.
(See Section 9.)
"Veteran of the Vietnam Era" means a veteran, any part of
whose military, naval or air service was during the period of August
5, 1964 through May , 1975 who (1) served on active duty for a
period of more than 180 days and was discharged or released
therefrom with other than a dishonorable discharge, or (2) was
discharged or released from active duty because of a service
connected disability. No veteran may be considered to be a veteran
of the Vietnam era under this paragraph after December 31, 1991.
"Veteran's Preference" means providing preference in
employment to veterans and certain eligible relatives of veterans
according to MCA 39-29. (See Section 14-2.)
"White (Non-Hispanic)" means a person having origins in
any of the original peoples of europe, Nother Africa or the Middle East,
