Smoking In Facilities

The Montana Clean Indoor Air Act, Title 50, Chapter 40,
Montana Codes Annotated, as amended by the 53rd Legislature, specifically
exempts the Montana University System from the requirement to designate
smoking areas in any buildings.

Smoking is hereby prohibited in the following areas of all
buildings: general office space; private offices, auditoriums, classrooms,
and conference rooms; elevators; corridors, lobbies, restrooms, and
stairways; health care facilities; libraries; and hazardous areas.

Montana State University hereby designates all
laboratories and all space within health related facilities, e.g., Student
Health, Health and Physical Education, Nursing, and Romney Gym as
Non-Smoking areas. All nonsmoking areas will be conspicuously signed,
declaring this designation.

Montana State University hereby designates all areas
within twenty-five (25) feet of any exterior surface of any building as
Non-Smoking areas. Enforcement of this provision is the
responsibility of individual Building Supervisors.
- The Building Supervisor may establish one (1) designated
smoking area in each building IF a building contains a space, suited by
architectural design and functional purpose, that can be used as a smoking
area. To be determined suitable for use as a designated smoking area, the
area must be enclosed so as to limit the smoke generated to the designated
area, and shall be provided with adequate ventilation or air purification
equipment. If nonsmokers cannot be adequately protected from the health
hazards of passive smoke from the proposed smoking area in a building,
then a smoking area shall not be declared and the entire building shall be
designated as smoke free.

In establishing designated smoking areas, the Building Supervisor shall
consult the Office of Facilities Services and consider:
- the number of smokers and nonsmokers in the building;
- the building ventilation system;
- the availability of suitable space; and
- the protection of nonsmokers from involuntary exposure to smoke.
- Signs shall be as approved and installed by the Office of
Facilities Services.
Residence Halls and Family Housing facilities are exempt
from this policy.
This policy shall become effective on the date the policy
is signed by the President (as noted above).
